ZSD E-SIGN Disclosure and Consent

This Electronic Signatures and Records Disclosure ("E-SIGN Disclosure") applies to all electronic communications, documents, records, and signatures related to your account with Zero Sum Defense, Inc. ("ZSD," "we," "us," or "our") and your use of the ZSD Platform and related services (collectively, the "Services").
Note: By clicking "I Agree" or similar buttons, or by continuing to use our Services after receiving this disclosure, you consent to the electronic delivery of communications and the use of electronic signatures in your relationship with ZSD as described in this disclosure.
BY CONSENTING TO THIS E-SIGN DISCLOSURE, YOU AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES OR PROVIDE ELECTRONIC SIGNATURES.
Disclosure Details
1.1 Electronic Delivery. By consenting to this E-SIGN Disclosure, you agree that ZSD may provide the following to you electronically:
- Agreements and policies, including the ZSD Services Agreement, Privacy Policy, and other legal documents;
- Account statements, confirmations, and transaction records;
- Notices, including those required by law, such as privacy notices and security breach notifications;
- Service announcements and communications;
- Marketing communications, including promotional offers and updates;
- Billing and payment information;
- Other information related to your account or our services.
1.2 Method of Electronic Delivery. We may deliver electronic communications to you in various ways, including:
- Email to the email address you have provided to us;
- Text messages to the mobile phone number you have provided to us (if you have opted in to text communications);
- Via your account dashboard or in-platform notifications;
- By making them available on our website or mobile applications;
- Through other electronic means that we may develop in the future.
1.3 Delivery Timing. Electronic communications will be considered delivered to you when they are sent or made available to you, regardless of whether you actually access or read them.
1.4 Multiple Copies. In some cases, you may receive both electronic and paper versions of certain communications. The electronic version will be considered the official record.
2.1 Legal Effect. By consenting to this E-SIGN Disclosure, you agree that electronic signatures, whether in the form of a digitized image, typed name, checkbox, button click, or other electronic means, have the same legal effect, validity, and enforceability as traditional handwritten signatures.
2.2 Forms of Electronic Signatures. Electronic signatures may include:
- Clicking "I Agree," "Submit," "Accept," or similar buttons;
- Checking or unchecking specific boxes;
- Digital signatures through third-party signature services;
- Typing your name or initials in designated fields;
- Using digital drawing tools to create a signature;
- Using biometric authentication methods (e.g., fingerprint, face recognition) when available.
2.3 Intent to Sign. When you use any of these electronic methods to affirm, acknowledge, accept, or consent to documents or transactions, you are indicating your intent to sign such documents or transactions electronically and your agreement to be bound by them.
2.4 Authentication. ZSD may use various methods to authenticate your identity when you sign documents electronically, including verification of account credentials, multi-factor authentication, or other security measures deemed appropriate for the particular transaction.
To access and retain electronic communications from us, you will need:
- Computer or Mobile Device: A device capable of accessing the Internet and displaying websites and applications.
- Operating System: Current versions of Windows, macOS, iOS, Android, or another compatible operating system.
- Browser: A current version of Chrome, Firefox, Safari, Edge, or another compatible browser.
- PDF Reader: Software capable of displaying PDF files, such as Adobe Acrobat Reader or a built-in PDF viewer.
- Email Account: An active email account that you can access regularly.
- Internet Connection: A connection to the Internet with sufficient bandwidth to download and view documents.
- Storage: Sufficient storage space on your device or a cloud storage service to save electronic communications.
Software Updates. ZSD may update its systems periodically. If these updates affect the hardware or software requirements needed to access or sign electronic documents, ZSD will notify you of these changes.
4.1 Keeping Information Current. You must keep your email address, phone number, and other contact information current in our records to ensure that we can deliver electronic communications to you.
4.2 How to Update Information. You can update your contact information by:
- Logging into your account and updating your profile settings;
- Contacting customer support at support@zerosumdefense.co;
- Submitting a request in writing to Zero Sum Defense, Inc., Attn: Customer Service, 7455 France Ave S, #277, Minneapolis, MN 55435.
4.3 Failed Delivery. If we receive notification that electronic communications sent to you have failed due to an invalid email address or other contact information, we may:
- Use alternative means to contact you;
- Suspend electronic delivery until you provide updated contact information;
- Send communications via traditional paper methods.
5.1 Right to Withdraw. You have the right to withdraw your consent to receive electronic communications at any time.
5.2 How to Withdraw Consent. To withdraw your consent, you may:
- Log into your account and update your communication preferences;
- Contact customer support at support@zerosumdefense.co;
- Submit a request in writing to Zero Sum Defense, Inc., Attn: Customer Service, 7455 France Ave S, #277, Minneapolis, MN 55435.
5.3 Consequences of Withdrawal. If you withdraw your consent to electronic communications:
- We will confirm your withdrawal and its effective date;
- We will begin sending communications via traditional paper methods to your mailing address on record;
- Paper communications may incur additional fees as specified in your ZSD Services Agreement;
- There may be delays in receiving communications;
- Certain features or services that require electronic delivery may become unavailable to you.
5.4 Partial Withdrawal. In some cases, you may be able to selectively withdraw consent for certain types of electronic communications while continuing to receive others electronically.
6.1 Right to Paper Copies. You have the right to request a paper copy of any electronic communication we send to you, even if you have consented to receive it electronically.
6.2 How to Request Paper Copies. To request a paper copy, you may:
- Contact customer support at support@zerosumdefense.co;
- Submit a request in writing to Zero Sum Defense, Inc., Attn: Customer Service, 7455 France Ave S, #277, Minneapolis, MN 55435.
6.3 Fees. We may charge a reasonable fee for providing paper copies of electronic communications. The fee structure will be disclosed to you at the time of your request.
6.4 Timing. Paper copies will typically be sent within 10 business days of your request.
7.1 Our Retention. ZSD will maintain electronic records in accordance with applicable laws and our internal record retention policies. However, you are encouraged to save or print copies of important electronic communications for your own records.
7.2 Access Period. Electronic communications related to your account will generally be accessible through your account for at least 24 months from the date of delivery, unless a longer period is required by law or specified in our ZSD Services Agreement.
7.3 Account Closure. If your account is closed, you may lose access to electronic communications stored in your account. You should save or print any important documents before closing your account.
7.4 Data Export. ZSD provides tools to export your account data as described in our Privacy Policy.
8.1 E-SIGN Act. This E-SIGN Disclosure is provided in compliance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and, where applicable, similar state laws.
8.2 Consent Verification. By providing your consent, you confirm that:
- You can access and read this E-SIGN Disclosure;
- You have an email account and can receive and access emails;
- You can print on paper or electronically save this E-SIGN Disclosure for your future reference;
- You are authorized to provide consent on behalf of all other account owners, if applicable.
8.3 State Law. If you reside in a state with additional requirements regarding electronic communications or signatures, the provisions of this E-SIGN Disclosure will be interpreted to comply with those requirements.
9.1 Updates. We may update this E-SIGN Disclosure from time to time to reflect changes in our practices or applicable laws. The updated disclosure will be posted on our website, and we will notify you of material changes as required by law.
9.2 Effective Date. The updated E-SIGN Disclosure will include the effective date of the changes.
9.3 Continued Consent. Your continued use of our services after the effective date of an updated E-SIGN Disclosure constitutes your acceptance of and consent to the changes.
