ZSD Intellectual Property Notice

This Intellectual Property Notice describes the proprietary rights of Zero Sum Defense, Inc. ("ZSD," "we," "us," or "our") in relation to the ZSD Platform, associated software, mobile applications, websites, and related services (collectively, the "Services").
ALL INTELLECTUAL PROPERTY RIGHTS IN AND TO THE SERVICES, INCLUDING BUT NOT LIMITED TO COPYRIGHTS, TRADEMARKS, TRADE SECRETS, AND PATENTS, ARE OWNED BY OR LICENSED TO ZSD. UNAUTHORIZED USE OF ANY INTELLECTUAL PROPERTY IS STRICTLY PROHIBITED.

1.1 ZSD Trademarks. The following are registered or unregistered trademarks or service marks of ZSD:
- Zero Sum Defense™
- ZSD™
- ZSD Secure Enclaves™
- Individual Sovereign Cloud™
- Entity Sovereign Cloud™
- ZSD-ID™
- The Zero Sum Defense logo
- The Actualize logo
- Actualize by Zero Sum Defense
1.2 Trademark Usage. The ZSD trademarks may not be used:
- In connection with any product or service that is not ZSD’s;
- In any manner that is likely to cause confusion among customers;
- In any manner that disparages or discredits ZSD;
- In a way that implies a false endorsement by or affiliation with ZSD;
- In advertising, promotional materials, or domain names without express written permission from ZSD.
1.3 Permitted Uses. Certain limited uses of ZSD’s trademarks may be permitted as outlined in our Marks Usage Guidelines, which should be consulted before any use.
1.4 Trademark Notice. When referring to ZSD’s trademarks in text, please use the appropriate trademark symbol (™ or ®) for the first or most prominent mention, and include a statement attributing the trademark to ZSD, such as: "[Trademark] is a trademark of Zero Sum Defense, Inc."
2.1 Protected Materials. The following materials are protected by copyright:
- The ZSD Platform, including its software code, design, and architecture;
- ZSD’s websites, mobile applications, and user interfaces;
- Documentation, guides, manuals, and other textual materials;
- Graphics, logos, icons, and images;
- Videos, animations, and other multimedia content;
- Blog posts, white papers, and other published content;
- Marketing materials and presentations.
2.2 Copyright Notice. All copyrightable materials created by or for ZSD are protected by copyright laws worldwide. Unless otherwise noted, the copyright for these materials is owned by Zero Sum Defense, Inc. All rights reserved.
2.3 Use Restrictions. Except as expressly permitted by law or by ZSD in writing, you may not copy, reproduce, distribute, republish, download, display, post, transmit, or create derivative works from any copyrighted materials owned by ZSD.
2.4 Limited License. ZSD grants users a limited, non-exclusive, non-transferable license to access and use the copyrighted materials as necessary to use the Services as permitted under the applicable Services Agreement.
2.5 Open Source. Certain components of ZSD’s software may incorporate open-source software, which is licensed under separate terms. A list of open-source software used in the Services, along with the applicable licenses, can be found in our Licenses page.
3.1 Patent Portfolio. ZSD owns or has licensed various patents and patent applications covering aspects of the Services, including but not limited to:
- Zero-knowledge security architecture;
- Secure data storage and transmission methods;
- Multi-factor authentication systems;
- Quorum driven systems
- Encryption and key management protocols;
- Secure enclave technologies;
- Distributed identity verification methods.
- Proprietary proactive defense systems
- Security Factor Management
- Development and deployment of zero trust architectures
- Data discovery, management, and orchestration for AI systems and compliance by design
3.2 Notice. One or more patents or pending patent applications owned by or licensed to ZSD may cover the Services. The existence of this notice should not be interpreted as an admission that any specific feature or component is covered by a particular patent.
3.3 No License. No license to any patent is granted by this notice or by use of the Services, except as explicitly provided in a written license agreement with ZSD.
4.1 Protected Information. ZSD possesses trade secrets and confidential information related to the Services, including but not limited to:
- Technical designs and architectural details;
- Algorithms and computational methods;
- Security implementations and vulnerability management strategies;
- Business methods and processes;
- Customer information and usage analytics;
- Research and development information;
- Strategic business plans.
- Data storage and processing methods and strategies.
- Data compliance strategies and approaches .
- Identity negotiation and verification methods.
4.2 Restrictions. You may not use, disclose, or disseminate any trade secrets or confidential information of ZSD, except as expressly permitted in writing by ZSD.
4.3 Reverse Engineering. You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or methods embodied in the Services, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
5.1 Third-Party Content. The Services may incorporate content, software, or other materials owned by third parties, including but not limited to open-source software, fonts, graphics, and other components. Such third-party content remains the property of its respective owners and is used by ZSD under license.
5.2 Third-Party Notices. Attribution notices, license terms, and other notices relating to third-party content are included in our Licenses page and/or in the relevant components of the Services.
5.3 No Warranty. ZSD provides no warranties or representations concerning any third-party content. Any such warranties or representations are governed by the applicable third-party license terms.
6.1 User Content. Users retain ownership of any content they upload, create, or store using the Services ("User Content"), subject to the limited license rights granted to ZSD in the Services Agreement.
6.2 Feedback. If you provide ZSD with any suggestions, comments, or feedback regarding the Services ("Feedback"), you hereby grant ZSD a worldwide, perpetual, irrevocable, royalty-free, fully paid-up, sublicensable, and transferable license to use, reproduce, modify, create derivative works from, distribute, publicly display, and otherwise exploit such Feedback for any purpose, without restriction or obligation to you.
6.3 No Compensation. ZSD is under no obligation to provide any compensation for User Content or Feedback.
7.1 Monitoring. ZSD actively monitors for unauthorized use of its intellectual property and takes steps to enforce its rights.
7.2 Reporting Infringement. If you believe that your intellectual property rights or those of ZSD are being infringed, please contact us at legal@zerosumdefense.co.
7.3 DMCA Compliance. ZSD complies with the Digital Millennium Copyright Act ("DMCA"). If you believe that content available through the Services infringes your copyright, you may send a DMCA notification to our designated agent at:

7.4 DMCA Requirements. Your DMCA notification must include:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material that is claimed to be infringing and where it is located;
- Your contact information, including address, telephone number, and email;
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or law;
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
ZSD reserves the right to modify this Intellectual Property Notice at any time. When we make changes, we will update the "Last Updated" date at the top of this page. We encourage you to review this notice periodically to stay informed about our intellectual property practices.
